Working Hours

General

The legal full-time schedule is 8 hours per day, 40 hours per week under the Portuguese Labour Code.

Overtime

  • Maximum Ordinary Hours: The standard work limit is 8 hours per day or 40 hours per week. Overtime (trabalho suplementar or extraordinário) is any work performed beyond these limits.
  • Consent: Overtime must be requested by the employer and is generally mandatory for the employee, unless they have extenuating circumstances for refusal (e.g., pregnancy, child under 12, or student status).
  • Daily Maximum: Total working time, including overtime, generally cannot exceed 12 hours per day.
  • Annual Overtime Cap (Statutory): The maximum annual limit for overtime hours is:
    • 150 hours per year for companies with 50 or more employees.
    • 175 hours per year for companies with fewer than 50 employees.
    • This limit can be extended up to 200 hours per year by a Collective Labour Agreement or in cases of force majeure.

Mandatory Overtime Pay Rates

Overtime compensation is structured based on the amount of overtime worked annually. These rates are mandatory minimum increases on the regular hourly wage.

Overtime up to 100 Hours Per Year
Day/Condition Minimum Premium Rate (Supplement) Total Pay Rate
Normal Weekdays (1st Hour) +25% of the regular hourly rate. 125%
Normal Weekdays (Subsequent Hours) +37.5% of the regular hourly rate. 137.5%
Weekly Rest Days & Public Holidays +50% of the regular hourly rate. 150%
Overtime Exceeding 100 Hours Per Year

Once an employee crosses 100 annual overtime hours, the premium rates increase for all subsequent hours:

Day/Condition Minimum Premium Rate (Supplement) Total Pay Rate
Normal Weekdays (1st Hour) +50% of the regular hourly rate. 150%
Normal Weekdays (Subsequent Hours) +75% of the regular hourly rate. 175%
Weekly Rest Days & Public Holidays +100% of the regular hourly rate. 200%

Compensatory Rest (Time Off in Lieu): Employees may opt to receive equivalent paid rest time instead of monetary compensation, typically on the basis of $1$ hour of overtime granting $1$ hour and $25$ minutes of rest (125%) for the first hour and $1$ hour and $37.5$ minutes of rest (137.5%) for subsequent hours.

Payroll

Payroll is processed monthly; tax and social security are withheld at source, with contributions generally remitted in the following month under Portuguese deadlines.

13th Salary

Portugal pays 14 months as standard: a holiday allowance (typically paid before vacation) and a Christmas allowance. These are statutory features of Portuguese pay practice and apply in the Azores as well.

Leave

Annual Leave (vacation)

The Portuguese Labour Code mandates a minimum of 22 working days of paid annual leave; in the year of admission, leave accrues at 2 working days per month, capped at 20 working days.

Paid time off

Because the Azores are part of Portugal, Portuguese labor law applies to paid annual leave and its carryover rules. Under the Portuguese Labour Code:

  • Annual leave is earned each calendar year and should generally be taken in that same year.
  • Unused annual leave cannot automatically be forfeited at year-end. Law expressly allows that unused leave may be carried over into the next year by mutual agreement between employer and employee (or under collective agreements).
  • Carried-over leave must be taken by 30 April (or 30 June in some first-year situations) of the following year, and only up to half of the leave from the prior year may be combined with the current year’s leave if agreed.
  • A blanket “use-it-or-lose-it” policy that cancels statutory annual leave simply because the year ended is not supported under Portuguese law.

Sick Days

In the Azores, employees get sick pay from Social Security after a 3-day waiting period, at 55–75% of salary depending on the length of absence, for up to 3 years.

Maternity Leave

Maternity leave is covered under Portugal’s parental leave system. Mothers must take six weeks of compulsory leave after childbirth. In total, parents are entitled to 120 days at 100% pay or 150 days at 80% pay, with costs borne by Social Security, not the employer. If both parents share leave, the entitlement may extend by 30 additional days.

Paternity Leave

Fathers in the Azores are entitled to 28 mandatory days of paternity leave, which can be split into blocks, plus 7 optional days to be taken during the mother’s initial leave. All paternity leave must be used within six months of the child’s birth.

Parental Leave

After the initial period, either parent may take extended parental leave until the child turns three years old. This leave is unpaid by the employer, but parents may qualify for Social Security family allowances during the period.

Bereavement Leave

Employees are entitled to 5 consecutive days of paid leave upon the death of a spouse, parent, child, or other close family member, in line with the Portuguese Labour Code.

Childcare Leave

There is no separate statutory childcare leave in Azores.

Termination

Termination Process

Termination in the Azores is strictly regulated under the Portuguese Labour Code, which sets out detailed procedures depending on the type of contract and grounds for dismissal. Contracts may end through resignation by the employee, dismissal for just cause (such as serious misconduct, repeated disobedience, or unjustified absences), redundancy based on economic, structural, or technological grounds, unsuitability where an employee demonstrably cannot fulfill their role even after training or redeployment, mutual agreement, or natural expiry of a fixed-term or temporary contract. Dismissals must always be communicated in writing, with employers required to provide clear justification and evidence supporting the decision. In cases of disciplinary dismissal, employers must follow a formal process including prior notification, opportunity for the employee to respond, and documentation of findings. For redundancies, employers are obliged to consult with employee representatives, notify labor authorities, and, in collective redundancy cases, explore redeployment options or mitigation measures. Any failure to comply with procedural requirements can render the dismissal unlawful, potentially leading to court-ordered reinstatement of the employee or significant compensation awards based on length of service and damages incurred.

Salary payment interval / date Final payment on termination Bank account payment requirement
The general rule in Portugal is that wages must be paid at regular intervals (typically monthly) unless otherwise agreed. On termination employers must pay all outstanding wages, unused holiday payment, and other entitlements. Not available

Notice Period

In the Azores, notice periods are defined by the Portuguese Labour Code and depend on the employee’s length of service rather than role. For contracts of less than one year, the minimum notice is 15 days. Employees with one to five years of service are entitled to at least 30 days’ notice, those with five to ten years receive 60 days, and those with more than ten years must be given 75 days’ notice. These periods apply to employer-initiated terminations not based on misconduct. In cases of disciplinary dismissal for just cause, no notice is required. Employers may also choose to provide pay in lieu of notice if they do not require the employee to work through the notice period.

Severance Pay

Employees dismissed for economic redundancy or unsuitability are entitled to severance compensation under Portuguese law. For open-ended contracts, the statutory compensation is generally 12 days of base salary and seniority allowances per year of service, subject to maximum caps, though transitional rules for older contracts may still apply. For fixed-term contracts, employees are entitled to 18 to 24 days of base salary per year of service, depending on whether the contract is definite or indefinite in duration. Severance does not apply in cases of dismissal for just cause or resignation. Collective agreements may improve upon these statutory amounts, and unlawful dismissals can result in reinstatement or court-awarded damages in addition to or instead of severance.

Probation Period

Probationary periods in the Azores follow the Portuguese Labour Code and vary by contract type and position. For indefinite contracts, the standard probation period is 90 days for most employees, 180 days for positions involving greater technical complexity, trust, or responsibility, and up to 240 days for senior management or executive roles. For fixed-term contracts, the probationary period is 15 days if the contract is shorter than six months, and 30 days if it is six months or longer. Probation allows either party to terminate the employment with minimal notice and without severance obligations.

Immigration

As an autonomous region of Portugal, the Azores are subject to Portuguese immigration law. EU/EEA/Swiss nationals may live and work without a permit, though registration is required. Non-EU nationals need a work visa (D1) and residence permit, processed initially at a Portuguese consulate and finalized with AIMA (the new immigration authority) in Portugal. Processing typically takes several weeks to a few months.

Minimum Wage

The Azores apply a regional minimum wage higher than mainland Portugal. As of January 2025, the statutory monthly minimum is €926.50, compared with €882.50 on the mainland.

VAT

The Azores apply a reduced VAT regime with rates of 16% (standard), 9% (intermediate), and 4% (reduced), with returns filed monthly or quarterly and payments generally due by the 10th or 15th of the following month.
