Working Hours

Working Hours

In Benin the work week is 8 hours per day, 40 weekly hours over 5 working days.

Employers are required to record working time and overtime.

Overtime

  • Maximum Ordinary Hours: The standard work limit is 40 hours per week (typically spread over five days at 8 hours/day). Any work beyond this is considered overtime.
  • Absolute Maximum Daily Hours: Total working time, including overtime, cannot exceed 12 hours per day.
  • Annual Overtime Cap: Overtime is strictly limited to 240 hours per year.
  • Consent: Overtime work is only permitted in cases of urgent necessity and generally requires authorization and agreement.
  • Exemptions: Managers and executives are typically exempt from the statutory overtime provisions.

Mandatory Overtime Pay Rates

Overtime compensation is mandatory and is calculated as a tiered minimum premium percentage of the employee’s regular hourly wage.

Overtime on Normal Working Days (Daytime)

The overtime premium increases significantly after the first 8 hours of overtime (i.e., after the $48^{\text{th}}$ hour of the work week).

Hours Worked (Beyond 40/week) Minimum Premium Rate (Supplement) Total Pay Rate Notes
$41^{\text{st}}$ to $48^{\text{th}}$ Hour (The first 8 hours of overtime) +12% of the regular hourly wage. 112% Lowest statutory premium for initial overtime.
Hours Beyond $48^{\text{th}}$ Hour +35% of the regular hourly wage. 135% Applies to hours worked beyond the first 8 hours of overtime.
Night Work and Weekly Rest Days

The premium rates are significantly higher for night work and work on designated rest days, and these premiums often supersede the normal weekday premiums.

Day/Condition Minimum Compensation Rate (Statutory) Total Pay Rate Notes
Night Overtime (Between 9:00 PM and 5:00 AM) +50% of the regular hourly wage. 150% This premium applies when overtime is performed at night.
Weekly Rest Day (Sunday) & Public Holidays +100% of the regular hourly wage. 200% This minimum premium is mandatory for all hours worked on the designated rest day or an official holiday.

Payroll

Payroll Frequency

Payroll Cycle

The payroll frequency in Benin is usually monthly, though it is permitted to pay semi-monthly or bi-weekly when agreed in the employment contract.

13th Salary

In Benin, there are no specific regulations mandating 13th or 14th salary payments.

Leave

Annual Leave (vacation)

A full-time employee is entitled to 30 calendar days (2.5 days per month) of paid leave per year.

The leave can be carried over to the next year for up to twelve additional months.

Paid time off

Under the Benin Labour Code, employees earn statutory paid annual leave (typically 2 days per month, ~24 days/year). However, the law itself does not clearly provide for automatic carryover of unused annual leave into the next leave year — the Code du Travail is silent on leave carryover rules. Any accumulation or deferment beyond the leave year would generally depend on collective agreements, contracts, or employer-employee arrangements. If leave isn’t taken before employment ends, the accrued leave must be paid out on termination. Employers cannot implement a policy that broadly cancels statutory leave simply because the year ended, but default statutory carryover rights aren’t expressly set out in law either

Public Holidays

If a public holiday falls on a Sunday an official notice or company policy shall determine if the following working day will be observed as a day off in lieu.

Workers with more than 12 months but less than 5 years of service receive full pay for first 3 months of sick leave and half pay for the next 3 months of sick leave. After 5 years of service, full pay is given for 6 months of the sick leave period.

Workers must present a medical certificate.

Maternity Leave

In Benin, female employees are entitled to a maternity leave period of 14 weeks. This leave includes 6 weeks before and 8 weeks after the expected date of childbirth. Maternity benefits are paid at full salary through the Social Insurance system (CNSS) for employees who have made sufficient contributions.

Under Collective Labor Agreements, fathers are entitled to 3 days of paid leave following the birth.

There is no additional parental leave granted under the law.
