Working Hours
General
In the Cayman Islands, the standard workweek is typically 45 hours, spread over five days, which translates to a typical workday of nine hours. However, there is some flexibility depending on the industry, especially in sectors like tourism where shifts can vary based on demand.
Overtime
-
Maximum Ordinary Hours: The statutory standard work limit is 9 hours per day or 45 hours per week. Overtime is triggered when an employee’s working hours exceed either of these limits.
-
Note: While 45 hours/week is widely cited as the statutory standard, some sources reference a 40-hour work week, indicating the need to refer to the specific employment contract or sector-specific regulations for the exact threshold. However, the 45-hour/9-hour limit is the common legal standard.
-
- Consent and Record-Keeping: Overtime is generally worked by arrangement. Employers must keep accurate work accounts to ensure compliance.
- Exemptions: Managerial and supervisory employees are often exempt from the statutory overtime provisions. The employment contract for such roles must clearly reflect this exemption.
Mandatory Overtime Pay Rates
The Labour Act mandates a minimum premium rate for overtime compensation.
| Day/Condition | Minimum Compensation Rate (Statutory) | Total Pay Rate | Notes |
| Normal Overtime (Working Days) | 1.5 times the employee’s basic hourly rate (Time and a half). | 150% | Applies to hours worked beyond 9 hours per day or 45 hours per week. |
| Public Holiday Work | 2 times the employee’s normal rate of pay for the hours actually worked. | 200% | This premium is paid for work performed on an official Public Holiday. |
Alternative Compensation (Time Off in Lieu):
Instead of monetary pay, overtime may be compensated with equivalent time off in lieu (non-cash compensation) that is equal to or in excess of the overtime pay due, provided this arrangement is agreed upon in the employment contract.
Payroll
Payroll Cycle
In the Cayman Islands, there is no mandated minimum payment frequency for payroll. However, it is common practice for employers to follow a monthly payroll cycle, aligning with the end of the calendar month.
13th Salary
In the Cayman Islands, there are no legal provisions requiring employers to pay a 13th or 14th salary. However, these additional salaries might be provided under certain conditions:
- Collective Agreements: If there is a collective agreement in place that includes provisions for a 13th or 14th salary.
- Employment Contracts: If an individual’s employment contract specifically includes these additional payments.
- Company Practice: If it is an established practice within the company to provide these additional salaries.
Leave
Annual Leave (vacation)
- Minimum Leave: Employees are entitled to a minimum of 14 working days of paid annual leave for each completed year of continuous service.
- Extended Leave: After ten years of continuous service with the same employer, this entitlement increases to 21 working days.
Paid time off

- Total Sick Leave: The maximum paid sick leave allowed in a given year is 12 days.
- Medical Certificate: Employers may require a medical certificate to validate the need for sick leave after three consecutive days.

Termination
Termination Process
Employers can terminate employment for various reasons, including redundancy, misconduct, or poor performance. However, the reasons must be justifiable and documented. Employers must provide the final paycheck, including any outstanding wages, vacation pay, and severance pay, within a specified period after termination. Employees who believe they have been unfairly dismissed can file a complaint with the Department of Labour and Pensions. The department will investigate and, if necessary, mediate between the employer and the employee.
| Salary payment interval / date | Final payment on termination | Bank account payment requirement |
|---|---|---|
| There is no legislated minimum salary-payment interval specified in the Labour Act; common practice is monthly pay for salaried employees. | Upon termination by employer (excluding for serious misconduct), the employer must pay wages, accrued leave and severance (where applicable). For severance, under the Labour Law (2011 Revision) the employer must pay the sum “simultaneously upon the termination” if employee is entitled. | The law does not clearly mandate that wages must always be paid via bank account. Payment in cash, cheque or other methods appears to be permitted under current guidance. |
Notice Period
- Probationary Employees: Both the employer and the employee must provide at least 24 hours’ written notice.
- Regular Employees: The notice period must be at least equal to the interval between the employee’s paydays or as specified in the employment contract.
Severance pay
In the Cayman Islands, severance pay requirements are outlined in the Labour Act. Here are the key points:
Eligibility: Employees who have completed at least one year of continuous service with their employer are entitled to severance pay if their employment is terminated for reasons other than misconduct or poor performance.
Calculation: Severance pay is calculated at a rate of one week’s wages for each completed year of service. This is based on the employee’s latest basic wage.
Probation Period
In the Cayman Islands, the probation period requirements are as follows:
- Duration: The initial probation period cannot exceed six months. This must be specified in writing in the employment contract.
- Extension: The probation period can be extended upon mutual agreement at the end of the initial term.
- Notice for Termination: During the probation period, either party must provide a minimum of 24 hours’ written notice for termination.
Minimum Wage
The current minimum wage in the Cayman Islands is 6.00 KYD per hour. For service workers who receive gratuities, the minimum hourly rate is 4.50 KYD.
MINIMUM WAGE (PER MONTH)
VAT
There is no VAT (Value-Added Tax) imposed in the Cayman Islands. Instead, the government relies on other forms of revenue, such as import duties and various fees.

the 1st of December I notify my employer my resignation to due the 17th, the 4th of the December during my regular shift they called me to meeting and they fired me with the reason that since I resigned they just decided to fired me before that, I’m been working from the 7th of September 2023, what am I supposed to receive in my pay off?
You should normally still be paid for all hours worked up to your last day, plus any accrued/unused vacation or other earned benefits (if applicable). Since termination rules can vary, it’s best to confirm your entitlements with the Department of Labour or a local HR/legal professional. This does not constitute legal advice.
