Overtime
The Working Time Act sets the absolute limits on total working time, including overtime, aligning with the EU Working Time Directive principles.
-
Standard Contract Hours: The statutory standard work week is commonly 37.5 to 40 hours. Overtime is work performed beyond the employee’s contracted hours.
-
Absolute Maximum Weekly Hours: A worker’s average working time, including overtime, shall not exceed 48 hours each week.
-
Averaging Period: This average is computed over a period of 17 weeks (this period can be extended up to 52 weeks by collective or workforce agreement).
-
Opt-Out: Workers aged 18 or over may agree in writing to opt out of the 48-hour average weekly limit.
-
Daily and Weekly Rest: Workers are entitled to a minimum rest period of 11 consecutive hours in each 24-hour period and at least 24 uninterrupted hours of rest (or 48 hours over 14 days) per week.
Overtime Compensation Rates
Gibraltar law does not mandate a universal minimum premium pay rate for general overtime. Compensation is determined by agreement, although specific statutory orders apply to certain trades.
| Day/Condition | Statutory Requirement (Employment Act/Working Time Act) | Notes |
| Minimum Pay Rate (General) | No statutory minimum premium is set for standard overtime. Compensation must be specified in the employment contract or collective agreement. | Payment or time off in lieu (TOIL) must be agreed upon in the contract. |
| Specific Sector Rates | Specific Conditions of Employment Orders (e.g., for the Retail Distributive Trade) mandate minimum rates. | For these sectors, a common minimum rate for weekday overtime is 1.5 times the regular pay, and 2 times for Sunday or Rest Day work. |
| Night Work (10 PM to 6 AM) | Night workers’ average normal hours must not exceed 8 hours in each 24-hour period. | Compensation for night work is generally determined by contract. |
Contractual Practice:
If the contract is silent, the legal minimum for non-exempt workers is the regular hourly rate. However, customary practice often involves enhanced rates (e.g., 150% for weekdays and 200% for weekends/public holidays) to be specified in the contract to attract and retain staff.
