Working Hours
General
In Haiti, the standard work week is 8 hours per day and up to 48 hours per week, Monday to Friday. Some industries might have 6 day work weeks, including Saturday. The usual workday runs from 8 am to 5 pm, including a one-hour lunch break from noon to 1 pm.
Overtime
-
Maximum Ordinary Hours: The standard work limit is 8 hours per day and 48 hours per week (typically spread over six days, Monday to Saturday). Any work beyond this is considered overtime (heures supplémentaires).
-
Daily Overtime Cap: Overtime is strictly limited to a maximum of 3 hours per day.
-
Absolute Overtime Cap (Quarterly): Overtime work must not exceed 80 hours per quarter (three months).7 This translates to an approximate annual cap of 320 hours.
-
Consent and Authorization: Night work (between 10:00 PM and 6:00 AM) requires special authorization from the employer or Labour Directorate.
-
Exemptions: While most employees are eligible for overtime, the law may specify exceptions based on job type or industry.
Mandatory Overtime Pay Rates
Overtime is compensated at minimum premium rates, which escalate significantly for night, Sunday, and public holiday work. Compensation is mandatory and must be monetary.
| Day/Condition | Minimum Compensation Rate (Statutory) | Total Pay Rate | Notes |
| Standard Overtime (Working Days) | 1.5 times the regular hourly wage (Time and a half). | 150% | Applies to hours worked beyond 48 hours per week. |
| Night Work (10:00 PM to 6:00 AM) | Additional compensation is required. | Varies | The Labour Code requires extra compensation for night work, which is cumulative with the standard 150% overtime rate if the night work is also overtime. |
| Weekly Rest Day (Sunday) & Public Holidays | 2 times the regular hourly wage (Double time). | 200% | This premium is mandatory for all hours worked on the designated weekly rest day or an official public holiday. |
Compensation Method: Compensation must be monetary. There is no provision to substitute monetary overtime pay with time off in lieu.
Leave
Annual Leave (Vacation)
In Haiti, employees are entitled to a minimum of 15 consecutive days of paid vacation leave after each year of continuous service. This vacation leave accrues proportionally throughout the year, and employees may take some leave before completing a full year with their employer’s agreement.
During vacation periods, employees receive their regular salary in full. Some industries or sectors may have collective agreements that provide more generous vacation leave entitlements than the legal minimum.
Under Haitian law, unused vacation leave typically cannot be carried over to the following year unless specifically stated in the employment contract or company policy. It is common for employees to lose unused leave if it isn’t taken within the year.
The annual leave cycle typically runs from January to December. However, this can be defined by the employer in the employment contract or company policies.
PTO carryover
In Haiti, statutory annual leave is a protected right. The law does not clearly provide for automatic carryover, but accrued vacation cannot be forfeited by policy. Unused statutory leave must be granted later or paid out on termination — a blanket “use-it-or-lose-it” rule is not supported.
Public Holidays
Holidays falling on weekends are usually lost.

Sick Leave
In Haiti, employees are entitled to paid sick leave according to the following:
- Eligibility: Employees become eligible for paid sick leave after completing a probationary period with their employer.
- Duration: Employees are entitled to up to 15 days of paid sick leave per year.
- Medical Certification: To qualify for paid sick leave, employees must provide a medical certificate from a recognized healthcare provider.
- Compensation: During sick leave, employees receive their regular salary. The employer is responsible for covering the sick leave pay.
Maternity Leave
Maternity leave in Haiti is governed by the Haitian Labor Code:
- Duration: Female employees are entitled to 12 weeks of maternity leave. This is typically divided into 6 weeks before the expected delivery date and 6 weeks after childbirth.
- Compensation: During maternity leave, employees receive their regular salary. The employer is responsible for covering the maternity leave pay.
- Job Protection: Employers are required to keep the employee’s job open during the maternity leave period, ensuring that the employee can return to the same or a similar position after the leave ends.
- Medical Certification: To qualify for maternity leave, employees must provide a medical certificate confirming the pregnancy and the expected delivery date.
Paternity Leave
In Haiti, there are currently no statutory laws that mandate paternity leave for fathers. This means that employers are not legally required to provide paid or unpaid leave specifically for new fathers. However, some employers may offer paternity leave as part of their company policies or through collective bargaining agreements.

Termination
Termination Process
There are 3 employment termination types in Haiti:
- With Cause: Employers can terminate employees for reasons such as serious misconduct or repeated absences.
- Without Cause: Employers can terminate employees without cause but must adhere to the notice period and severance pay requirements.
- By Employee: Employees can resign by providing proper notice as per their contract.
Employers must document the reasons for termination and provide written notice specifying the termination date. If terminating without cause, the notice must be given in writing or verbally in the presence of two witnesses. In cases of serious misconduct, employers can terminate employees immediately without notice or severance pay.
It is common to terminate using Mutual Termination Agreements.
| Salary payment interval / date | Final payment on termination | Bank account payment requirement |
|---|---|---|
| Pay timing is by agreement, but may not exceed 15 days for manual workers and 1 month for intellectual (non-manual) workers. | The Code does not set a single national “within X days” deadline for all final wages. At termination, employer must settle statutory items, including the pro-rated annual bonus (“boni”) (Art. 156), and must issue the employment certificate stating the last day and salary (Art. 52). In practice, employers settle on the last day or next pay date. | Wages must be paid in legal tender (Art. 138) and on working days at the place of work (Art. 142). The Code does not mandate payment into a bank account; cash/legal-tender payment is expressly recognized. |
Notice Period
Employers must provide a notice period when terminating employees who have been in service for more than three months. The length of the notice period depends on the duration of employment:
- 3 to 12 months: 15 days’ notice
- 1 to 3 years: 1 month’s notice
- 3 to 6 years: 2 months’ notice
- 6 to 10 years: 3 months’ notice
- Over 10 years: 4 months’ notice
Severance Pay
Employees are entitled to severance pay upon termination without cause, except in cases of serious misconduct or where the worker resigns. The severance pay is calculated based on the length of service:
- 3 to 12 months: Half a month’s wage
- 1 to 3 years: 1 month’s wage
- 3 to 6 years: 2 months’ wages
- 6 to 10 years: 3 months’ wages
- Over 10 years: 4 months’ wages
Probation Period
In Haiti, the probation period for new employees is typically 3 months. During this time, either the employer or the employee can terminate the employment relationship without notice or severance pay.
Immigration
To obtain a work visa in Haiti, the process generally involves the following steps:
- Application Submission: The worker must submit a completed application to the Ministry of Labor and Social Affairs. This includes:
- A completed and signed application form.
- Two passport-sized color photos.
- A letter explaining the reason for their stay and providing any in-country references.
- Contact information and current address.
- A valid passport or another travel document.
- A letter from the employer.
- Residence Permit: In addition to the work permit, the worker must apply for a residence permit if they plan to stay for more than three months. This application is submitted to the Department of Immigration in Port-au-Prince.
- Processing Time: The processing time for a work visa typically ranges from two to six months. Delays can occur if any required documents are missing or incomplete.
- Approval and Issuance: Once approved, the work permit is valid for one year and can be renewed up to five times.
