Working Hours

Standard working hours are 40 hours a week, 8 hours per day for adults.

Overtime

Aspect Regulation Details
Maximum Ordinary Hours 8 hours per day and 40 hours per week. Any work beyond this is considered overtime (trabalho suplementar).
Daily Overtime Cap Overtime is limited to 2 hours per day.
Absolute Maximum Work Time Total working time, including overtime, may not exceed 48 hours per week, calculated as an average over a four-month reference period.
Annual Overtime Cap The maximum annual limit for overtime is:
  • 150 hours per year for companies with 50 or more employees.
  • 175 hours per year for companies with fewer than 50 employees.
This can be extended to 200 hours in specific cases (e.g., force majeure or by Collective Bargaining Agreement).
Consent Employees are generally obligated to comply with overtime requests unless they have valid reasons to refuse (e.g., parental obligations).

Mandatory Overtime Pay Rates

Overtime compensation is mandatory and is structured based on a progressive minimum premium percentage of the employee’s regular hourly wage.

Day/Condition Hours Worked (Beyond 40/week) Minimum Compensation Rate (Supplement) Total Pay Rate Notes
Normal Overtime (Tier 1) First hour of overtime in a workday. +25% of the regular hourly wage. 125% This rate applies to the first hour of overtime worked Monday–Friday.
Normal Overtime (Tier 2) Subsequent hours of overtime in the same workday. +37.5% of the regular hourly wage. 137.5% The premium increases for the second and subsequent hours of overtime.
Weekly Rest Days & Public Holidays All hours worked on rest day/holiday. +50% of the regular hourly wage. 150% This premium is mandatory for work on the designated weekly rest day or an official public holiday.

Compensation Method

Compensation can be provided as monetary pay or as equivalent time off in lieu, by agreement.

Compensation Method Statutory Requirement Notes
Primary Method Monetary payment at the applicable premium rate. The $25\%$ and $37.5\%$ premiums for overtime are subject to a 50% reduction in withholding tax rates, lightening the tax burden on supplemental earnings.
Alternative Method Compensatory rest time (Descanso Compensatório). Employees may opt for compensatory rest instead of monetary compensation, typically to be taken within a specified period following the overtime worked.

Payroll

Payroll cycle is monthly, wages paid by the last working day of each month.

13th Salary

It is mandatory, employees receive 14 payments/year, i.e. 12 monthly salaries + holiday bonus (June) + Christmas bonus (December)

Leave

Annual Leave (vacation)

22 working days/year after one year of service.

PTO carryover

Madeira follows Portuguese labor law. Statutory annual leave does not automatically expire at year-end. Carryover into the next year is allowed by agreement, but carried-over leave must generally be taken by 30 April of the following year (with limited exceptions). A blanket “use-it-or-lose-it” policy that deletes statutory PTO is not lawful.

Termination

Termination Process

In Madeira (Portugal), employment contracts can be terminated by mutual agreement, the employee’s resigna-tion, dismissal by the employer, the expiry of a fixed-term contract, or retirement. Dismissal by the employer must be based on valid grounds such as redundancy, misconduct, or unsuitability for the role. For redundancy or other economic reasons, employers must follow strict procedures, including providing written notice, con-sulting the employee, and, in some cases, informing the labor authorities or employee representatives. Termination must always respect procedural fairness and comply with the Portuguese Labor Code.

Salary payment interval / date Final payment on termination Bank account payment requirement
Salaries are generally paid monthly, with pay day typically on or before the last working day of the month. On termination, the employer must pay all wages, unused leave, and other entitlements due at the end of employment according to the Portuguese Labor Code. Payment must be made in euros and in money (legal tender).

Notice Period

  • During probation: 7–30 days depending on length of probation
  • After probation:
    • 15 days (up to 1 year service)
    • 30 days (1–5 years)
    • 60 days (5–10 years)
    • 75 days (over 10 years)

Severance Pay

When termination occurs due to economic reasons or redundancy, employees in Madeira are entitled to severance pay. The standard calculation provides 20 days of base pay and seniority allowances for each full year of service, capped at 12 months’ pay. Severance is not required for dismissal due to disciplinary reasons when proven misconduct occurs.

Probation Period

The probationary period in Madeira varies according to the employee’s role. It is 90 days for most standard contracts, 180 days for employees in positions with higher technical complexity or trust responsibilities, and 240 days for management-level employees or company directors. During this period, either party may terminate the employment contract with reduced or no notice, depending on the duration of the probation.

Immigration

Foreign nationals from outside the EU/EEA must obtain both a residence visa and a work permit before starting employment in Madeira (Portugal). The process typically begins with the employer providing a job offer, after which the employee applies for a residence visa through the Portuguese consulate in their home country. Once in Portugal, the employee applies for a work permit and residence card with the Portuguese Immigration and Borders Service (SEF). Processing times can take up to 60 days depending on documentation and workload. EU/EEA and Swiss citizens do not require a visa but must register their residence if staying longer than 90 days.

Minimum Wage

As of 2025, the statutory minimum wage in Madeira is EUR 915 per month. This amount applies to all full-time employees regardless of sector and is reviewed annually by the Portuguese government to account for inflation and economic conditions. Employers must comply with this wage floor, and collective bargaining agreements may set higher minimums for specific industries or professions.

Returns are filed monthly if turnover exceeds EUR 650,000, otherwise quarterly, with payments typically due by the 20th–25th of the following month.
