Termination

Termination Process

Termination of employment contracts in Saint Kitts and Nevis is governed by the Employment Act (Cap. 18.27), which sets out clear procedures and protections for both employers and employees.
A contract may be terminated through:

  • Resignation by the employee,

  • Dismissal for misconduct, incapacity, or poor performance,

  • Redundancy (economic or structural reasons),

  • Mutual agreement, or

  • Expiry of a fixed-term contract.

For a dismissal to be lawful, the employer must:

  • Provide written notice stating the reason(s) for termination,

  • Allow the employee to respond to allegations in cases of misconduct or performance issues, and

  • Follow due process under the Employment Act or any applicable collective agreement.

In redundancy situations, the employer must consult affected employees, provide written notice to the Labour Commissioner, and ensure fair selection criteria are applied.
Unfair dismissal claims can be brought before the Labour Commissioner and may result in reinstatement or compensation orders if the dismissal is found to be unjustified.

Notice Period

Under the Employment Act, notice requirements depend on the employee’s length of continuous service and payment frequency:

Length of Service Notice by Employer Notice by Employee
Under 1 year 1 week 1 week
1 – 3 years 2 weeks 2 weeks
3 – 5 years 3 weeks 3 weeks
Over 5 years 1 month 1 month

Employers may give payment in lieu of notice if they wish to end the employment immediately.
No notice is required for dismissal due to gross misconduct, provided the employer can substantiate the cause.

Severance Pay

Employees terminated for reasons other than gross misconduct are entitled to severance pay after completing one year of continuous service, as prescribed under the Protection of Employment Act.

The statutory formula is as follows:

  • 2 weeks’ basic pay for each completed year of service up to the first 10 years, and

  • 3 weeks’ pay for each additional year beyond 10 years.

  • The maximum severance entitlement is generally capped at 52 weeks’ pay.

Enhanced severance benefits may apply under collective bargaining agreements, employer policies, or contractual terms.

Probation Period

Probationary periods are allowed under the Employment Act but must be clearly stated in writing in the employment contract.

  • Typical duration: Up to 3 months for standard employees.

  • Extended probation: May reach 6 months for managerial or technical positions, if agreed upon by both parties.
During probation, either party may terminate the contract with short notice (usually one week) and without cause.
