Termination

Termination Process

The employment relationship under the Labour Act Cap 16.04 (Revised Laws of Saint Lucia) can be ended by various methods:

  • Resignation (employee initiated).

  • Termination by employer for valid reason (misconduct, incapacity, redundancy, fixed‐term expiry etc.).

  • Expiry of a fixed‐term contract (no further obligation if contract ends naturally).

  • Redundancy (economic/structural reason). When redundancy, special rules apply including informing and consulting the employee/trade union.

  • Mutual agreement termination.

Employers must follow valid reason requirements and procedural fairness. For example, summary dismissal must meet the serious misconduct standard.

Notice Period

Length of continuous employment Minimum notice by employer to terminate
More than 12 weeks but less than 2 years 1 week
2 years or more but less than 5 years 2 weeks
5 years or more but less than 10 years 4 weeks
More than 10 years 6 weeks

Severance / Redundancy Pay

  • Employees terminated by reason of redundancy after at least 2 years continuous employment are entitled to redundancy pay

  • The redundancy pay formula: For years 1-3: one week’s basic pay per year; years 4-7: two weeks’ basic pay per year; years 8 and beyond: three weeks’ basic pay per year. (Basic pay defined as last week’s pay or a set cap – in one example “$350” per week was used in illustrative calculation)

  • Note: In the case of termination for valid reason (misconduct, incapacity, etc), severance may not apply; the Act distinguishes redundancy vs other termination reasons

Probation Period

  • A probationary period may be agreed in the employment contract. According to employer guidance: up to 3 months is typical.

  • During probation, less notice may be required (the Act provides for termination without reference to a time‐limit contract during probation).

Immigration

  • Under section 317(1)&(2) of the Labour Act (Saint Lucia), a foreign national cannot engage in employment in Saint Lucia unless there is in force a valid work permit (or exemption) and the person is employed in accordance with the terms of that permit.

  • Employers wishing to hire a foreign national must apply to the Department of Labour, provide a job offer, and justify the hiring of a non-national (e.g., local shortage) in many cases.

  • Work permits are generally issued for specified durations (often one year), and must be renewed if employment continues beyond that period.

  • Fees and processing: (example figures) Temporary Work Permit ~ EC$ 500; Permanent Work Permit ~ EC$ 1,000 for certain categories.

Minimum Wage

Minimum wage is EC$ 1,131 per month.
