13th Salary

The 13th Salary in Senegal is customary and generally paid at the end of the year.

Working Hours

General

The standard work week consists of 40 hours over a maximum of 6 days per week.

Overtime

Aspect Regulation Details Notes
Maximum Ordinary Hours 40 hours per week (generally 8 hours per day, over 5 or 6 days). Overtime (heures supplémentaires) is any work performed beyond the 40-hour threshold.
Daily/Weekly Cap Total working hours, including overtime, generally should not exceed 56 hours per week. Total overtime hours per day is often limited to 2 hours per day.
Annual Overtime Cap Overtime is capped at 100 hours per calendar year (as per Decree No. 2006-1262), although some sources cite 200 hours under specific authorization. The cap can be increased exceptionally with the authorization of the Labour Inspector.
Authorization Overtime should generally be authorized in advance, but employees are entitled to compensation even for unauthorized overtime.
Exemptions Executive and high managerial positions and workers involved in emergency work are typically exempt from the standard overtime payment rules.

Mandatory Overtime Pay Rates (Tiered System)

Overtime compensation is mandatory and is calculated as a minimum premium percentage of the employee’s regular hourly wage. Rates vary significantly depending on when the overtime is worked.

Day/Condition Hours Worked (Beyond 40/week) Minimum Premium Rate (Supplement) Total Pay Rate
Normal Overtime (Tier 1) First 8 hours of weekly overtime (Hours 41–48). +15% of the regular hourly wage. 115%
Normal Overtime (Tier 2) Subsequent hours of weekly overtime (Hours 49+). +40% of the regular hourly wage. 140%
Night Overtime (10:00 PM to 5:00 AM) All hours of overtime during night hours. +60% of the regular hourly wage. 160%
Weekly Rest Day (Sunday) & Public Holidays (Daytime) All hours worked on rest day/holiday. +60% of the regular hourly wage. 160%
Night Work on Rest Day/Holiday All night hours worked on rest day/holiday. +100% of the regular hourly wage (Double Pay). 200%

Note on Conflicting Sources: Due to reliance on implementing decrees and collective agreements, different sources cite varying rates (e.g., $110\%/135\%$ or $120\%/150\%$). The $115\%/140\%$ rates are widely cited for the first and subsequent tiers under the Inter-professional CBA.

Compensation Method

  • Monetary Pay: Compensation must be paid as a monetary premium at the applicable statutory rates.

  • Time Off in Lieu (TOIL): The employee may choose to receive compensatory rest time (equal to the premium hours worked) in lieu of the overtime remuneration for work on a rest day or holiday, though this choice must be clearly documented.

Leave

Annual Leave (vacation)

Employees are entitled to 24 working days of paid annual leave.

PTO carryover

In Senegal, statutory annual leave cannot be forfeited. The law does not clearly grant an automatic carryover right, but unused leave must be taken later or paid out on termination.

Public Holidays

Public holidays falling on weekends are usually lost unless decreed otherwise by the local government.

Religious holidays are determined by the lunar cycle and will show as tentative until they are confirmed nearer the date of the holiday.

Termination

Termination Process

Employers can terminate a fix term contract by giving the following reasons – business, personal, or workers misconduct. It requires notice and a written explanation for the termination. If the reason is misconduct, a warning needs to be given and the employee gets a chance to explain actions.

Salary payment interval / date Final payment on termination Bank account/payment-method requirement
Wages must be paid at regular intervals: For daily or weekly paid workers, payment must not exceed 15 days; for monthly paid workers, payment must be made by the 8th day of the following month. On termination, the employer must pay all wages owed, accrued leave, and applicable severance/indemnities. The law specifies severance proportions (e.g., 25 % per year of service for first 5 yrs, etc.) but does not clearly state a universal “within X days after termination” deadline for all payments in the publicly-accessible sources. Wages must be paid in legal tender (West African CFA francs) at the workplace or agreed place.

Notice Period

The statutory notice period is dependent upon the job role and industry.

Employers may terminate employees for just cause with eight days to one month notice depending on the length of service for white-collar workers, blue-collar workers, and permanent hourly, daily, or weekly employees. Three months written notice is given to executives.
Employees can terminate a contract with 15 days’ written notice, although technicians and supervisors must provide two months notice.

Severance Pay

Severance pay is 25-40% of the average wages over the past 12 months for each year of service depending on the length of service and the collective bargaining agreement.

Probation Period

Typically, the probation period is three months for executives and 1 month for non-executives.

Immigration

Work permits are required for foreign individuals wishing to take up employment and residence in Senegal. The type of required work permit depends on the employee’s qualifications and duration of work.

Visas are compulsory for all foreign nationals traveling to Senegal, except nationals from ECOWAS, Mauritania, and Morocco.

VAT

General

The Standard rate of VAT in Senegal is 18%.
