Working Hours
General
Standard working hours within Sri Lanka are 8 hours per day, 45 hours per week
There are some industry-specific regulations, for example, according to Section 73 of the Factories Ordinance, a young person shall not be employed in a factory on a Sunday.
Overtime
| Aspect | Regulation Details | Notes |
| Maximum Ordinary Hours | 8 hours per day and 45 hours per week (under SOEA, which covers most white-collar workers). | Some sectors, like Factories, use a 48-hour week standard. Overtime is work beyond the statutory limit. |
| Absolute Daily Cap | The total spread-over of work, including rest and overtime, cannot exceed 12 hours in a day. | |
| Maximum Overtime Cap | Overtime hours are generally capped at a maximum of 12 hours per week for most employees covered under the SOEA and Factories Ordinance. | This limit is set to prevent employee burnout. |
| Exemptions | Employees holding executive or managerial positions are generally exempt from the statutory working hours and overtime provisions. |
Mandatory Overtime Pay Rates
Overtime compensation is mandatory and is calculated as a minimum premium percentage of the employee’s ordinary rate of pay.4 Different rates apply based on the day of work.
| Day/Condition | Statutory Minimum Compensation Rate (Multiplier) | Total Pay Rate | Notes |
| Standard Overtime (Beyond 45 or 48 hours/week) | 1.5 times the ordinary hourly rate (Time and a half). | 150% | This is the standard minimum rate for overtime on normal working days. |
| Poya Day Work (Full Moon Holiday) | 1.5 times the normal daily wage. | 150% (of daily wage) | Applies if the employee is required to work on this specific religious holiday. |
| Official Public Holiday Work | 2 times the normal daily wage. | 200% (of daily wage) | This premium is mandatory for work on an official public holiday (e.g., National Day, May Day, Christmas Day). |
| Weekly Rest Day Work | No statutory premium is provided for working on the weekly rest day (Sunday) under the SOEA, but the compensation is often 1.5x to 2x via sector-specific Wages Board determinations. | Varies |
Compensation and Rest
| Aspect | Statutory Requirement | Notes |
| Weekly Rest | Employees covered by the SOEA are entitled to one whole day and one half-holiday per week. | |
| Public Holiday Compensation | If an employee works on a Public Holiday, they are entitled to the $\mathbf{200\%}$ premium OR be allowed a holiday with full pay on or before December 31st of the same year. | |
| Calculation | For salaried employees, the hourly rate used to calculate overtime is generally derived by dividing the monthly salary by 240 (or similar figure representing the standard monthly hours). |

Termination
Termination Process
Employers can terminate a fix-term contract by giving the following reasons – business, personal, or employees misconduct. It requires notice and a written explanation for the termination.
Employers are required to pay a half month’s salary for each year of completion if the employee’s service period exceeds five years at the time of retirement, resignation, or retrenchment.
Concessionary tax rates apply to sums paid to an employee on cessation of employment when the scheme is uniformly applicable to all employees by way of compensation, commuted pension, retirement gratuity, and contributions to the Employees’ Trust Fund. Accumulated employer’s contribution to an approved or regulated provident fund when withdrawn, is exempt from tax.
| Salary payment interval / date | Final payment on termination | Bank account/payment-method requirement |
|---|---|---|
The wage period must not exceed one month. Under the Wages Boards Ordinance (No. 27 of 1941) employers must fix the wage period, and:
|
When employment ends, the employer must pay wages and any other monetary entitlements due as a result of the employment relationship. For “workmen” under the Termination of Employment of Workmen (Special Provisions) Act (No. 45 of 1971) the employer may have to pay compensation/gratuity. | Wages must be paid in legal tender (the Sri Lankan rupee) and directly to the worker. Under the Wages Boards Ordinance Section 2 the employer must pay “in legal tender” and “directly to the worker”. |
Notice Period
The minimum statutory notice period is determined within the job role and respective contract/agreement, however, general notice periods are for a maximum of six months.
Severance Pay
Employers are required to pay a half month’s salary for each year of completion if the employee’s service exceeds 5 years at the time of retirement, resignation, or dismissal.
Probation Period
There is no clear provision in labor laws on the duration of the probation period in Sri Lanka. Generally, the probation period is six months, however, it cannot be for longer than one year for senior employees or six months for other employees (in some cases the maximum limit on a probationary period is three months).
Immigration
All foreign nationals must obtain visas to enter Sri Lanka. Foreign nationals intending to work in Sri Lanka should obtain residence visas and work permits. Residence visas are issued for one year and renewable annually. Applicants for residence visas should obtain entry permits from Sri Lankan missions in their home countries and submit applications within one month after arrival in Sri Lanka under entry visas. The approval of the relevant ministry that governs a particular activity or the BOI, as applicable, is critical in obtaining a residence visa.
Employers are responsible for applying for residence visas for expatriate staff. The Resident Guest Scheme is open to any foreign investor or foreign professional who wishes to contribute to the economic and sociocultural enrichment of Sri Lanka. Five-year visas are issued to individuals qualifying under the scheme. Individuals applying for visas under the Resident Guest Scheme must undergo a medical examination prior to the visas’ confirmation.
VAT
General
The standard rate of VAT in Sri Lanka is 8% (with a current proposal to increase to 12%).
