Federal Employee Income Tax

For bona fide residents of the Virgin Islands, there is no separate federal income tax payable to the IRS.

  • The same brackets shown above apply under the mirror code.

  • Instead of paying to the IRS, residents file and pay with the USVI Bureau of Internal Revenue (BIR).

  • Non-residents with split income may file with both IRS and USVI (Form 8689).

Working Hours

General

In Virginia, the standard working week consists of a maximum of 40 hours per week, eight hours per day.

Overtime

150% of regular pay for hours over daily/weekly limits.

Payroll

Payroll Cycle

Employees are paid either semi-monthly or biweekly.

13th Salary

There is no legislation for 13th-month payments in Virgin Islands.

Leave

Annual Leave (vacation)

No territorial statute requiring paid vacation for private employers; accruals are set by contract or policy (common U.S. practice).

Public Holidays

Public holidays are not mandatory to give as paid days off, however, it is very common to allow workers to take federal holidays as paid days off.

Some companies might also agree to allow workers to take off state holidays. Workers can find the specific state holiday dates from their local government.

Usually when an agreed public holiday falls on a weekend, a day off in lieu is given on the Friday before or the Monday after the holiday.

Sick Days

The federal FMLA applies to covered employers: up to 12 weeks unpaid, job-protected leave (26 weeks for military caregiver). Employers commonly provide separate paid sick leave by policy; no universal territorial paid-sick-leave statute.

Maternity Leave, Paternity and Parental

No universal private-sector paid maternity/paternity law; FMLA governs eligibility for unpaid, job-protected leave (supplemented by employer policy or CBA).

Other Leave

Virginia law requires all employers to provide their full-time employees job-protected but unpaid leave for jury duty or as a witness in a case, responding to a subpoena, or acting as a plaintiff or defendant in the courts.

Employees must provide a copy of the jury summons to the employer as evidence of requirement.

Termination

Termination Process

Employment in the U.S. Virgin Islands generally follows the U.S. “at-will” doctrine, meaning either the employer or the employee may terminate the employment relationship at any time, with or without cause or notice, unless there is a written employment contract, collective bargaining agreement (CBA), or specific statute that provides otherwise.

  • At-will employment: Employers are not legally required to give reasons for dismissal, provided the termination is not unlawful (e.g., discriminatory based on race, sex, age, disability, national origin, religion, or other protected category under U.S. and Virgin Islands law).

  • Just cause contracts: For executives, professionals, or unionized employees, contracts often contain “just cause” provisions, which limit termination to specified reasons such as misconduct, poor performance, or redundancy. In such cases, procedures outlined in the contract or CBA must be followed.

  • Unlawful dismissal: Terminations motivated by discrimination, retaliation, or in violation of whistleblower protections can lead to reinstatement orders, back pay, and/or damages.

WARN Act (Mass Layoffs):
The federal Worker Adjustment and Retraining Notification (WARN) Act applies in the U.S. Virgin Islands. Employers with 100 or more employees must provide 60 days’ advance notice of a plant closure or mass layoff affecting a large number of employees.

Notice Period

  • For most employees, no statutory notice is required under at-will employment.

  • Many employers expect or request two weeks’ notice from resigning employees as a matter of practice.

  • Some contracts and CBAs may specify formal notice periods, which must then be observed.

Severance Pay

  • Not mandated by law in the Virgin Islands.

  • Severance may be provided under a contract, CBA, or employer policy. Common formulas, when offered, are based on years of service (e.g., one week’s pay per completed year).

Probation Period

  • No statutory probationary period requirement exists.

  • Employers frequently use a 90-day probationary period for new hires, during which performance is evaluated and termination can occur with little formality.

Minimal Statutory Termination Costs

Some states require PTO balances to be paid out during termination, also any bonuses or commissions that were promised in the employment contract

Immigration

As a U.S. territory, USVI follows U.S. work authorization rules. U.S. citizens/green-card holders may work without additional permits. Non-U.S. citizens require the appropriate U.S. visa/work authorization (e.g., H-1B, L-1, O-1, etc.), petitioned through USCIS.

Minimum Wage

$10.50 per hour (general minimum since June 1, 2018). Tipped “tourist services/restaurant” employees: $4.20 cash wage with tip credit to reach $10.50 minimum.

VAT

No general sales tax. Instead, USVI imposes a 5% Gross Receipts Tax on business revenues (with a $9,000 monthly exemption and annual filing threshold rules). Separate hotel/occupancy and excise taxes may apply
